Outside Business Activities can be confusing! Here are some tips to help navigate OBAs and know when and how to submit them to Cetera Advisors.
- Common scenarios that REQUIRE an OBA submission:
- Holding a fiduciary role such as trustee, successor trustee, power of attorney, guardian, executor or a similar position for any person or entity, including immediate family members.
- The OBA category for this activity is “Trustee, Power of Attorney, Guardian, Executor or Similar Role”
- Note: If approved for this role, you must report all applicable brokerage accounts through the Firm’s brokerage account reporting tool (ECM in Adviceworks).
- Serving on a Board or Committee for any organization, both volunteer or elected. Examples of board positions may include a Board Member, President, Treasurer or Secretary. Examples of committee positions may include an Investment or Finance committee or any role where you are in a position to discuss investments, finances or raising funds for the organization.
- The OBA category for this activity is “Board or committee Positions”
- Note: If you have access to, or are responsible for, funds of the organization, a copy of the organization’s bylaws or charter detailing the controls for access to funds will be required.
- Creating an LLC.
- The OBA category for this activity is “Other Outside Business Activity”
- Note: If the LLC has other owners/members, this will also require approval as a Private Securities Transaction.
- Being a Notary Public. The OBA category for this activity is “Other Outside Business Activity”.
- Receiving rental income from property you personally own. The OBA category for this activity is “Personal Rental Property”.
- Any position with access to funds or check writing capabilities even in a volunteer capacity.
- Example: You volunteer at your local sports club to collect all fees from participants.
- How to submit an OBA:
- In AdviceWorks> Click on your name in the upper right-hand corner and select Licensing & Registration.
- In the Licensing & Registration (L&R) Dashboard> Click on Rep Maintenance.
- Select Reporting Outside Business Activities in the left-hand column.
- Click either Add New OBA or Update Existing OBA Disclosure at the top of the page.
- Note: The default answers to all categories is “No”. You can only submit one OBA at a time. Only answer “Yes” regarding the OBA you are trying to add or update. Leave all other categories as No.
- To terminate an existing OBA, please email compliance@prosperityadvisors.com. The Prosperity Network Compliance team will submit the OBA termination to Cetera Advisors on your behalf.

Tips when using the L&R Tool:
- If you have more than one OBA to submit, it will require separate submissions in the L&R tool. You can only submit one OBA at a time.
- For new OBA submissions, the Start Date is the date you personally began (or will begin) the activity.
- For OBA updates, the Start Date is the date of the update. For example, you have an existing approved OBA for being the President of the Rotary club. Next month your role is changing to be the Treasurer. The OBA update Start Date is the date you changed roles.
- Make sure all fields marked with an asterisk (*) are completed.
- When entering the city, begin typing the first 3-4 letters of the city and then select the applicable city and state.
- Make sure all the “I understand” statements at the bottom of the submission are checked.
- The “Print Name” at the bottom of the submission is for First Name and Last Name. Do not put any initials.
