New Branch and State Registrations

June 30, 2025

If you are a registered person and either move to a new state or purchase a home (even a second home) in another state, the following steps must be followed:

  • Submit the new address or address change in the L&R tool in AdviceWorks
  • At the same time, request any applicable state registrations if you are not already registered in that state.
  • Alert the Prosperity Network OSJ by emailing ops@prosperityadvisors.com or calling 913-529-5500.

Note: Some states may have additional requirements.

The Prosperity Network OSJ can assist you with making these changes in the L&R tool and/or requesting the new state registrations. Don’t hesitate to reach out to our Ops team.

If you are moving to a new state, you will need to request a state advisory license in order to conduct advisory business in that state. This should be done at the same time that you provide the new address to L&R. Once Cetera has approved the request, you will receive an email from the Licensing and Registration team confirming the approval.

If you will be conducting securities or annuity business at a location in a new state (including a part-time residence) you are required to notify the Broker/Dealer that you have an additional branch location.

If you are only conducting the following activities, the location may be reported as a non-registered branch location:

  • Solicit the purchase or sale of securities.
  • Effect transactions – You place orders to buy, sell or exchange securities.
  • Customer service – You make and take calls, or send and receive emails, to service clients.
  • Administrative Activities – These are those operational, support functions that are not sales activities. Examples are processing paperwork, setting appointments, drafting letters, etc.

However, if any of the below activities are conducted, the location must be set up as a Registered Branch location:

  • Maintain hard copy books and records – An example would be client files or paperwork in a file or desk drawer.
  • Meet clients or prospects at the location.
  • Receive hard copy business related mail.
  • Receive physical checks and/or securities certificates.
  • List the address on any public facing communications, including but not limited to your email signature block, business cards, letterhead, websites, or business social media accounts.

If you are going to conduct business from a branch in a new state, most states require a state advisory license in order to conduct advisory business in that state (even if you don’t reside in that state). Contact Cetera’s Licensing & Registration team or the Prosperity Network OSJ to confirm if you need to add the state Advisory license in this scenario.at the same time that you submit the request/address.

As a reminder, all residential and office moves or changes are required to be reported within 30 days to remain compliant.
